Chapitre Ier - Du génocide, Article 211-1:

ANNEXE LIVRE II DES CRIMES ET DELITS CONTRE LES PERSONNES TITRE Ier DES CRIMES CONTRE L'HUMANITE C HAPITRE Ier Du génocide Art. 211-1. - Constitue un génocide le fait, en exécution d'un plan concerté tendant à la destruction totale ou partielle d'un groupe national, ethnique, racial ou religieux, ou d'un groupe déterminé à partir de tout autre critère arbitraire, de commettre ou de faire commettre, à l'encontre de membres de ce groupe, l'un des actes suivants: - atteinte volontaire à la vie; - atteinte grave à l'intégrité physique ou psychique; - soumission à des conditions d'existence de nature à entraîner la destruction totale ou partielle du groupe; - mesures visant à entraver les naissances; - transfert forcé d'enfants. Le génocide est puni de la réclusion criminelle à perpétuité. Les deux premiers alinéas de l'article 132-23 relatif à la période de sûreté sont applicables au crime prévu par le présent article . C HAPITRE II Des autres crimes contre l'humanité Art. 212-1. - La déportation, la réduction en esclavage ou la pratique massive et systématique d'exécutions sommaires, d'enlèvements de personnes suivis de leur disparition, de la torture ou d'actes inhumains, inspirées par des motifs politiques, philosophiques, raciaux ou religieux et organisées en exécution d'un plan concerté à l'encontre d'un groupe de population civile sont punies de la réclusion criminelle à perpétuité. Les deux premiers alinéas de l'article 132-23 relatif à la période de sûreté sont applicables aux crimes prévus par le présent article . Art. 212-2. - Lorsqu'ils sont commis en temps de guerre en exécution d'un plan concerté contre ceux qui combattent le système idéologique au nom duquel sont perpétrés des crimes contre l'humanité, les actes visés à l'article 212-1 sont punis de la réclusion criminelle à perpétuité. Les deux premiers alinéas de l'article 132-23 relatif à la période de sûreté sont applicables aux crimes prévus par le présent article . Art. 212-3. - La participation à un groupement formé ou à une entente établie en vue de la préparation, caractérisée par un ou plusieurs faits matériels, de l'un des crimes définis par les articles 211-1, 212-1 et 212-2 est punie de la réclusion criminelle à perpétuité. Les deux premiers alinéas de l'article 132-23 relatif à la période de sûreté sont applicables au crime prévu au présent article . C HAPITRE III Dispositions communes Art. 213-1. - Les personnes physiques coupables des infractions prévues par le présent titre encourent également les peines suivantes: 1o L'interdiction des droits civiques, civils et de famille, selon les modalités prévues par l'article 131-26; 2o L'interdiction d'exercer une fonction publique, selon les modalités prévues par l'article 131-27; 3o L'interdiction de séjour, selon les modalités prévues par l'article 131-31; 4o La confiscation de tout ou partie de leurs biens. Art. 213-2. - L'interdiction du territoire français peut être prononcée dans les conditions prévues par l'article 131-30, soit à titre définitif, soit pour une durée de dix ans au plus, à l'encontre de tout étranger coupable de l'une des infractions définies au présent titre. Les exceptions prévues aux 1o à 4o de l'article 131-30 ne sont pas applicables. Art. 213-3. - Les personnes morales peuvent être déclarées responsables pénalement de crimes contre l'humanité dans les conditions prévues par l'article 121-2. Les peines encourues par les personnes morales sont: 1o Les peines mentionnées à l'article 131-39; 2o La confiscation de tout ou partie de leurs biens. Art. 213-4. - L'auteur ou le complice d'un crime visé par le présent titre ne peut être exonéré de sa responsabilité du seul fait qu'il a accompli un acte prescrit ou autorisé par des dispositions législatives ou réglementaires ou un acte commandé par l'autorité légitime. Toutefois, la juridiction tient compte de cette circonstance lorsqu'elle détermine la peine et en fixe le montant. Art. 213-5. - L'action publique relative aux crimes prévus par le présent titre, ainsi que les peines prononcées, sont imprescriptibles.

CHAPTER II: Other crimes against humanity

Article 212-1 The deportation, the reduction in slavery or the massive and systematic practice of executions summary, of removals of people followed of their disappearance, torture or inhuman acts, inspired by reasons political, philosophical, racial or religious and organized pursuant to a plan concerted against a group of civil population are punished criminal reclusion with perpetuity. The first two subparagraphs of article 132-23 relating to the period of safety are applicable to the crimes laid down by this article.

Article 212-2 When they are made in times of war pursuant to a plan concerted against those which fight the ideological system with the name of which are perpetrated crimes against humanity, the acts aimed to article 212-1 are punished criminal reclusion with perpetuity. The first two subparagraphs of article 132-23 relating to the period of safety are applicable to the crimes laid down by this article. Article 212-3 The participation in a formed grouping or an agreement established for the preparation, characterized by one or more material facts, of the one of the crimes defined by articles 211-1, 212-1 and 212-2 is punished criminal reclusion in perpetuity. The first two subparagraphs of article 132-23 relating to the period of safety are applicable to the crime laid down with the present article.

 

CODE PENAL CHAPTER III: Common provisions

Article 213-1 The guilty physical people of the infringements envisaged by this title also incur the following sorrows: 1° the prohibition of the civic rights, civil and of family, according to the methods envisaged by article 131-26; 2° prohibition to exert a public office, according to methods' envisaged by article 131-27; 3° the prohibition of stay, according to the methods envisaged by article 131-31; 4° confiscation of whole or part of their goods.

Article 213-2 (Law n° 93-1027 of 24 August 1993 Article 33 Official Journal of August 29, 1993) (Law n° 98-349 of 11 May 1998 Article 37 Official Journal of May 12, 1998) The prohibition of the French territory can be marked under the conditions envisaged by article 131-30, either on a purely final basis, or for one ten years duration at most, against any guilty foreigner of the one of the infringements defined in the present title. The provisions of the last seven subparagraphs of article 131-10 are not applicable.

Article 213-3 The people morals can be declared penally responsible for crimes against humanity under the conditions envisaged by article 121-2. The sorrows incurred by the people morals are: 1° sorrows mentioned in article 131-39; 2° confiscation of whole or part of their goods.

Article 213-4 The author or the accomplice of a crime aimed by this title cannot be exonerated from his responsibility for the only fact that it achieved an act prescribed or authorized by legislative or lawful provisions or an act controlled by the legitimate authority. However, the jurisdiction holds account of this circumstance when it determines the sorrow and into fixed the amount.

Article 213-5 The public action relating to the crimes envisaged by this title, as well as the pronounced sorrows, are imprescriptible.



Article 132-23: In the event of judgment with a sentence of emprisonment, not matched deferment, of which the duration is equal or higher than ten years, marked for the infringements especially envisaged by the law, condemned cannot profit, for one period of safety, from the provisions concerning the suspension or fractionation of the sorrow, the placement outside, the permissions to come out, semi-freedom and the release on parole. The duration of the period of safety is half of the sorrow or, if it is about one judgment to the criminal reclusion with perpetuity, ten eight years. The court of sat or the court can however, by special decision, either to carry these durations until two thirds of the sorrow or, if it is about one judgment to the criminal reclusion with perpetuity, up to twenty-two years, or to decide to reduce these durations. In the other cases, when it pronounces a sentence of one duration emprisonment higher than five years, not matched deferment, the jurisdiction can fix one period of safety during which condemned can profit from none the methods execution sorrow mentioned with the first subparagraph. The duration of this period of safety cannot exceed two thirds of the marked sorrow or twenty-two years in the event of judgment with the criminal reclusion with perpetuity. The reductions of sorrows granted for the period of safety will be charged only to the part of the sorrow exceeding this duration.

Jurisdiction:

The Cour de Cassation, the highest court in Frnace, holds that France has universal jurisdiction over genocide and crimes against humanity.

An investigating magistrate had opened a criminal investigation against a Rwandan priest, Wenceslas Munyeshyaka, for genocide and crimes against humanity committed in Rwanda in 1994. On 6 January 1998, the Cour de Cassation rejected a challenge to the investigating magistrate's jurisdiction and held that there was universal jurisdiction under international law based on Security Council Resolution 955, which established the International Tribunal for Rwanda and which was implemented by Law 96- 432 of 22 May 1996.
